  1. Preamble
    The present general terms and conditions of sale (hereinafter referred to as “Terms and Conditions”) are concluded between

Hereinafter referred to as “RABBITS WORLD”, and on the
other hand, the persons, private individual or not, wishing to make a purchase via the online sales site (Internet) www.rabbits.world
hereinafter referred to as the “Customers” or the “Customer” individually.
RABBITS WORLD and Customers together hereinafter referred to as the “Parties”.
The website www.rabbits.world hereinafter commonly referred to as the “RABBITS WORLD website”.
The delivery of the parcels can only be carried out territorially in Metropolitan France and certain European countries if available in the choice of the delivery countries. For any other country, it is necessary to contact RABBITS WORLD beforehand
. RABBITS WORLD offers its products exclusively via the Internet network (Sites or electronic mail), by telephone or by mail
RABBITS WORLD does not have a shop outside its Internet sites. All products sold by RABBITS WORLD are listed on the company’s websites (hereinafter referred to as the “Products”).
RABBITS WORLD does not distribute a paper catalogue.

  1. Purpose
    The present general conditions aim at defining the terms of sale between RABBITS WORLD and its Customers, from the order to the delivery, through the use of the services made available by RABBITS WORLD and through the payment.
    They regulate all the steps necessary for the placing of the order and ensure the follow-up of this order between the Parties.
    If the present terms and conditions were to be different according to the quality of the Customer, private individual or company, these differences would be mentioned in a clear way.
  2. Scope of application
    The present Conditions govern the sale of the Products found on the RABBITS WORLD Sites on the day the order is placed by the Customer.
    They apply to all the methods of placing orders proposed by RABBITS WORLD, whether the order was placed by Internet, by e-mail, by telephone or by post.
    If the present Conditions were to differ according to the method of placing the order, these differences would be clearly mentioned.
  3. Any order form signed by the validation click constitutes an irrevocable commitment by the customer which can only be called into question in the case exhaustively provided for in the present contract in the article “Right of withdrawal”.
  4. The order
    Capacity to contract:
    The purchase of a product found on the RABBITS WORLD web site is not an act of daily management. In accordance with article 1124 of the French Civil Code, all RABBITS WORLD clients declare that they are fully capable of entering into a Sales Order under the conditions described hereafter.
    RABBITS WORLD reserves the right to refuse any Order from a Customer with whom a dispute exists or appears during the processing of an Order, in particular a payment dispute.
    Acceptance of the Conditions by the Customer:
    The present Conditions can be read directly on the RABBITS WORLD website. On request of the Customer, they can also be sent by e-mail, by fax or by post.
    The fact that the Customer ticks the box “I have read the general sales conditions and I accept them” before validating his order automatically entails the express acceptance of the present Conditions without restriction or reserve. The Customer acknowledges by this act that he/she has read and understood the present Conditions and accepts them.
    Purchasing by e-mail, telephone or post also implies acceptance of these Conditions, which the Customer acknowledges having previously read, understood and accepted under the conditions mentioned above.
    Characteristics of the products: In
    accordance with the article L 111-1 of the code of consumption, RABBITS WORLD endeavours to present as well as possible, on the data sheets of the Products, the essential characteristics of the latter of which the Customer must take note.
    RABBITS WORLD reserves the right to modify the assortment of Products according to the constraints of its suppliers.
    The information and characteristics are those given by the suppliers. RABBITS WORLD is in no way responsible for erroneous data transmitted by the suppliers.
    The photographs and graphics presented on the websites or in the e-mails sent by RABBITS WORLD are given for information purposes only. In particular, RABBITS CONCEPT STORE cannot be held responsible for the difference in perception of the shapes and colours between the photographs or graphics presented and the Products.
    RABBITS WORLD will do its best to ensure that the photographic representation of the Products on the RABBITS WORLD Sites is as faithful as possible. Nevertheless, it is possible that the perception of the Product(s) does not correspond completely to the Product(s).
    Unless otherwise specified on the RABBITS WORLD Sites, all the Products sold by RABBITS WORLD are new, and are in conformity with the legislation of the European community in force and the standards applicable in France.
    Refusal of an order:
    RABBITS WORLD reserves the possibility of not confirming an order for any reason whatsoever, notably due to a problem of supply of products, or to a problem concerning the order received.
    Price:
    The prices of the Products are indicated in euros, including all taxes and excluding shipping costs. They take into account the VAT applicable on the day of the order. Any change in the applicable rate may be reflected in the prices of the Products after the date on which the new applicable rate comes into force.
    The VAT rate applied is a percentage of the value of the goods sold, 20.00% for delivery in Metropolitan France. For EU countries the taxes are those in force in each country. Outside the EU, prices are exclusive of tax. A customs form is provided for the carrier.

Shipping costs:
Shipping costs are charged to the Customer according to the weight and dimensions of the package, the place of delivery and the carrier.
They are indicated to the Customer before the final registration of the order.
Product availability:
The vast majority of products on the www.rabbits.world website are available and in stock. The stock is kept up to date in real time, according to the orders. No order will be taken for orders that are no longer available in stock. In the event of a stock error, the customer will be immediately reimbursed for the order, free of charge, and without any compensation (apart from the full reimbursement of the Order) being claimed by the customer.

Registration / Order Confirmation
An e-mail is automatically sent to the Customer to inform him/her of the registration of his/her order, provided that the e-mail address indicated in the registration form is correct.

  1. Payment
    Means of payment :
    When a Customer is a private individual, he/she can pay his/her order:
    – On line on the RABBITS WORLD website by bank or credit card (credit card, Visa card, Eurocard, Mastercard) via the secure PayPal application.

The transaction is carried out via Paypal, which alone has the banking information provided on the site at the time of payment.

It is not necessary to have a PayPal account to make a payment by credit card.

  1. The delivery

An e-mail is automatically sent to the Customer when the Products are dispatched, provided that the e-mail address indicated in the registration form is correct.
Delivery time :

All orders placed on the RABBITS WORLD website will be shipped, for products in stock, within 48 hours. In addition to this delay, there is a delivery delay. As an indication, this delay is 48 hours (Colissimo for France)

Necessary elements for the delivery:
RABBITS WORLD reminds its customers that : –
The delivery address (which can be different from the invoicing address) must be exact and mention all the details necessary for a good delivery;
– For a delivery by appointment, the Customer must clearly inform a fixed telephone number and/or a mobile phone number where he can be easily reached;
– For a delivery of bulky product, it is the responsibility of the Customer to ensure the conditions of accessibility of the place, the floor or the room of delivery and to inform RABBITS WORLD or the carrier of it during the appointment.
If the delivery could not be carried out for reasons of accessibility, RABBITS WORLD could not be held responsible for it.
– An error of address of delivery, place of delivery, accessibility of the place, telephone number for the appointment, absence of the Customer to the fixed appointment, or any other problem leading to the necessity to carry out a new delivery can be the subject of an invoicing with the real expenses of the new delivery, the payment of these additional expenses only allowing the new delivery.
At the time of delivery, RABBITS WORLD recommends that the customer check the condition of the products delivered before signing the acknowledgement of receipt of the package.

Reimbursement of transport in case of delay.

Some carriers guarantee their transport times and will refund under certain conditions if the time limit is exceeded.
GLS: no refund in case of long delays
Mondial Relay: no refund in case of long delays
Colissimo: full or partial refund depending on the delay. The refund amounts are those in force according to the Colissimo scales.
In this case, Rabbits World will take the necessary steps and refund you.
IMPORTANT: in case of special events, the conditions of reimbursement or delay may be suspended: climatic accidents, strikes, etc.
In all cases, Rabbits World will only reimburse what is reimbursed by the carrier.

  1. Force majeure

In addition to those usually accepted by the jurisprudence of the French courts and tribunals, the following are expressly considered to be cases of force majeure
: – total or partial strikes, internal or external to the company, governmental or legal restrictions, computer breakdowns, blocking of telecommunications, including networks and in particular the Internet.
The occurrence of a case of force majeure shall initially suspend the execution of the order by operation of law.

  1. Complaint for non conformity
    In case of error on the product, the customer commits himself to return the said product or the products concerned within 14 days following their reception to RABBITS WORLD according to the same modalities as those of the right of retraction.
    Upon receipt of the product in due form, RABBITS WORLD will send back, at its own expense, the product initially ordered.
  2. Right of withdrawal
  1. In accordance with the provisions in force (article L221-18 of the Consumer Code), the buyer has a period of 14 days to exercise his right of withdrawal from a contract concluded at a distance (telephone canvassing or off-premises).

The period runs from the day :

  • of the conclusion of the contract, for contracts for the provision of services;
  • receipt of the goods by the consumer or a designated third party, other than the carrier, for contracts for the sale of goods.

In the case of an order for several goods delivered separately or in the case of an order for a good composed of multiple lots or parts whose delivery is staggered over a defined period of time, the time limit shall run from the receipt of the last good or lot or part.

In the event of a dispute concerning the exercise of the right of withdrawal, the burden of proof lies with the consumer in accordance with Article L221-22 of the Consumer Code.

  1. 3. According to Article L221-28 of the Consumer Code, the right of withdrawal is excluded for :
  • services fully performed before the end of the withdrawal period and where performance has begun after the consumer has given his prior express consent and expressly waived his right of withdrawal;
  • goods made to the consumer’s specifications or clearly personalised;
  • goods likely to deteriorate or expire quickly;
  • goods unsealed by the consumer after delivery and which cannot be returned for reasons of hygiene or health protection;
  • audio or video recordings or computer software when unsealed by the consumer after delivery;
  • sales of newspapers, periodicals or magazines, except for subscription contracts;
  1. When the buyer makes use of his right of withdrawal, the products must be returned in their original packaging and in perfect condition to RABBITS WORLD 125 rue de l’artisanat, 42210 CIVENS within 7 days following the notification to the seller of the decision to withdraw.

The seller shall reimburse the consumer for all sums paid, including delivery costs, without undue delay and at the latest within 14 days from the date on which he is informed of the consumer’s decision to withdraw.

For sales of goods, the seller may defer the refund until the goods have been recovered or the consumer has provided proof that the goods have been shipped.

The refund shall be made by the same means of payment as the one used by the consumer for the original transaction.

The buyer is responsible for the costs of returning the goods.

  1. According to Article L221-17 of the Consumer Code, the exercise of the right of withdrawal puts an end to the parties’ obligation.

Withdrawal from a main distance contract automatically terminates any ancillary contract, without any costs for the consumer other than those provided for in Articles L221-23 to L221-25 of the Consumer Code.

  1. Guarantee

Legal guarantee of conformity and legal guarantee of hidden defects

The seller RABBITS WORLD is liable for defects in conformity of the goods with the contract under the conditions of articles L217-4 and following of the French Consumer Code and for hidden defects in the goods sold under the conditions of articles 1641 and following of the French Civil Code.

If the legal guarantee of conformity is invoked, the consumer :

  • has a period of 2 years from the delivery of the goods to act ;
  • may choose between repairing or replacing the goods or, failing that, reducing the price or rescinding the contract, subject to the cost conditions laid down in Article L217-12 of the Consumer Code. The goods shall be brought into conformity within a reasonable period of time, which may not exceed 30 days following the consumer’s request and without major inconvenience to the consumer, taking into account the nature of the goods and the use intended by the consumer;
  • is exempted from proving the existence of the lack of conformity of the goods during the 2 years from the delivery of the goods. This period is extended to 12 months for second-hand goods.

The legal guarantee of conformity applies independently of any commercial guarantee that may have been granted.

The consumer may decide to implement the guarantee against hidden defects of the thing sold within the meaning of Article 1641 of the Civil Code. In this case, he can choose between the resolution of the sale or a reduction of the sale price in accordance with Article 1644 of the Civil Code.

It is up to the buyer to prove the existence of a hidden defect.

  2. Electronic signature

The “validation click” constitutes an electronic signature.
This electronic signature has the same value between the parties as a handwritten signature.

  1. Proof
    The computerized registers, kept in the computer systems of RABBITS WORLD in reasonable conditions of security will be considered as proof of communication, orders and payments between the parties.
    The archiving of order forms and invoices is carried out on a reliable and durable support that can be produced as proof.
  2. Intellectual property
    RABBITS WORLD is the holder of the intellectual property rights on the site and of the right to distribute the elements appearing on the catalogue of the electronic shop and in particular the photographs for which it obtained the necessary authorizations from the persons concerned.
    Consequently, the partial or total reproduction, on any medium whatsoever, of the elements making up the site and the catalogue, their use as well as their provision to third parties are formally prohibited.
    Any person having an Internet site wishing to place on his site a simple link referring directly to the RABBITS WORLD site must request authorization from RABBITS CONCEPT STORE.
    An authorisation given by RABBITS WORLD will not constitute an implicit affiliation agreement and will not be given on a permanent basis.
    Upon simple request from RABBITS WORLD, this link must be removed.
    Any hypertext link to the www.rabbits.worldet website using “framing” or “in-line linking”
    techniques is strictly forbidden.
  3. Completeness of the contract and nullity
    A change in legislation, regulations or a court decision rendering one or more clauses of these General Terms and Conditions null and void shall not affect the validity of these General Terms and Conditions.
    Such a change or finding shall in no way allow the Customer to disregard these General Terms and Conditions of Sale.
    If a condition is not explicitly mentioned, it will be considered as governed by the practices in force in the distance selling sector whose companies are based in France.
  4. Non-waiver

The fact that RABBITS WORLD does not take advantage of a breach of any of its obligations by the customer shall not be interpreted as a waiver of the obligation concerned and of the right to take advantage of this breach later.

In the event of a dispute concerning a purchase made on the www.rabbits.world website, the buyer may make a complaint to Rabbits World by e-mail info@rabbits.world or by using the contact form

  1. Dispute
    This contract is subject to French law, both for the rules of substance and form.

In the event of a dispute and in the absence of an amicable agreement between the parties, the consumer may refer the matter either to one of the courts with territorial jurisdiction under the Code of Civil Procedure or to the court of the place where he lived at the time of the conclusion of the contract or of the occurrence of the harmful event.

  1. Duration and application

These Terms and Conditions apply to all purchases made on the www.rabbits.world website. The present Conditions can be modified at any time by v. The applicable Conditions are those in force at the date of the order registration.
