They regulate all the steps necessary for placing the order and ensure the tracking of this order between the Parties. If these conditions were to differ depending on the quality of the Customer, individual or company, these differences would be clearly mentioned.

3. Scope of Application

These Conditions govern the sale of Products found on the RABBITS WORLD Websites on the day the order is placed by the Customer. The products offered are intended for the feeding and well-being of domestic rabbits. They apply to all order placement methods offered by RABBITS WORLD, whether the order was placed via the Internet, email, phone, or postal mail. If these Conditions were to differ depending on the order placement method, these differences would be clearly mentioned.

4. Order Placement

Any order form signed by the validation click constitutes an order validation binding the customer, which can only be challenged in the cases exhaustively provided for in this contract under the “Right of Withdrawal” article.

5. The Order

Capacity to contract: The purchase of a product found on the RABBITS WORLD company websites not being an act of daily life management, in view of compliance with Article 1124 of the Civil Code, any customer of the RABBITS WORLD company declares to have the capacity to contract under the conditions described below, i.e., to be an emancipated minor or to have reached legal majority and not be protected within the meaning of Article 488 of the Civil Code. RABBITS WORLD reserves the right to refuse any Order from a Customer with whom there is or appears to be a dispute during the processing of an Order, in particular a payment dispute. The seller also reserves the right to refuse an order in case of suspected fraud or previous dispute.

Acceptance of the Conditions by the Customer: These Conditions can be read directly on the RABBITS WORLD website. Upon simple request from the Customer, they can also be sent by email, fax, or postal mail. The fact that the Customer checks the box “I have read the general terms and conditions of sale and I accept them” before validating their order automatically entails express acceptance by the latter, without restriction or reservation, of these Conditions. The Customer acknowledges by this act having read and understood these Conditions and accepting them. Purchasing by email, phone, or postal mail also implies acceptance of these Conditions, which they acknowledge having previously read, understood, and accepted under the conditions mentioned above.

Product characteristics: In accordance with Article L 111-1 of the Consumer Code, RABBITS WORLD strives to present as best as possible, on the technical sheets of the Products, the essential characteristics of the latter which the Customer must be aware of. RABBITS WORLD reserves the right to modify the assortment of Products depending in particular on constraints related to its suppliers. The information and characteristics are those provided by the suppliers. RABBITS WORLD is in no way responsible for erroneous data transmitted by suppliers. The photographs and graphics presented on the sites or in emails sent by RABBITS WORLD are given for indicative purposes only. In particular, the difference in perception of shapes and colors between the photographs or graphics presented and the Products cannot engage the liability of RABBITS WORLD. RABBITS WORLD will make its best efforts to ensure that the photographic representation of the Products on the RABBITS WORLD Websites is as faithful as possible. It is nevertheless possible that the perception of the Product(s) does not completely correspond to the Product(s). Unless otherwise specified on the RABBITS WORLD Websites, all Products sold by RABBITS WORLD are new and comply with the European community legislation in force and the standards applicable in France.

Refusal of an order: RABBITS WORLD reserves the right not to confirm an order for any reason whatsoever, relating in particular either to a product supply problem or to a problem concerning the order received.

Price: The prices of the Products are indicated in euros, all taxes included and excluding shipping costs. They take into account the VAT applicable on the day of the order. Any change in the applicable rate may be reflected in the prices of the Products after the effective date of the new applicable rate. The VAT rate applied is a percentage of the value of the goods sold, 20.00% for delivery in Metropolitan France. For EU countries, the taxes are those in force in each country. Outside the EU, prices are exclusive of taxes. A customs slip is provided for the carrier.

Shipping costs: Shipping costs are billed to the Customer based on the weight and dimensions of the parcel, the place of delivery, and the carrier. They are indicated to the Customer before the final registration of the order.

Product availability: Products are offered within the limits of available stocks. The vast majority of products on the www.rabbits.world website are available and in stock. The stock is updated in real-time, based on orders. No order will be taken for products that are no longer available in stock. In the event of a stock error or unavailability after ordering, the customer will be informed as soon as possible and will be immediately refunded for their order, without fees, and without any compensation (other than the full refund of the Order) being claimable by the customer.

6. Order Registration / Confirmation

An email is automatically sent to the Customer to inform them of the registration of their order, provided that the email address indicated in the registration form does not contain any errors. This email serves as order confirmation.

7. Payment

Payment methods: When a Customer is an individual, they can pay for their order:

  • Online on the RABBITS WORLD website by bank or credit card (Carte Bleue, Visa, Eurocard, Mastercard) via the secure PayPal application.

The transaction is carried out via PayPal, which alone has the banking information provided on the site at the time of payment. It is not necessary to have a PayPal account to make a payment by credit card.

8. Delivery

An email is automatically sent to the Customer at the time of shipment of the Products, provided that the email address indicated in the registration form does not contain any errors.

Transfer of risk: The transfer of risks occurs at the moment the customer physically takes possession of the products.

Delivery time: Any order placed on the RABBITS WORLD website will be shipped, for products in stock, within 48 business hours. To this time must be added the transit times. As an indication, this time is 48 hours (Colissimo for France).

Elements necessary for delivery: RABBITS WORLD reminds its customers that:

  • The delivery address (which may be different from the billing address) must be accurate and mention all the details necessary for proper delivery;

  • For delivery by appointment, the Customer must clearly provide a landline and/or mobile phone number where they can be easily reached;

  • For the delivery of bulky products, it is the Customer’s responsibility to ensure the accessibility conditions of the place, floor, or delivery room and to inform RABBITS WORLD or the carrier when making the appointment. If the delivery could not be carried out for accessibility reasons, RABBITS WORLD cannot be held responsible.

  • An error in the delivery address, place of delivery, accessibility of the place, phone number for making an appointment, absence of the Customer at the scheduled appointment, or any other problem resulting in the need to make a new delivery may be subject to billing at the actual cost of the new delivery, the payment of these additional costs alone allowing the new delivery. Upon delivery, RABBITS WORLD recommends that the customer check the condition of the delivered products before signing the parcel receipt acknowledgment.

Absence of free delivery during promotional periods: Unless otherwise expressly stated on the RABBITS WORLD Website or on a specific offer, free delivery benefits do not apply during promotional periods, sales, special offers, or occasional discounts. During these periods, delivery costs are billed according to the usual pricing conditions in force at the time of the order.

Delivery by DPD in Metropolitan France:

  • Delivery area: DPD Relais services are available exclusively in France.

  • Delivery times: Parcels are delivered within 24 to 72 hours.

  • Choice of relay point: DPD may redirect the parcel to another relay point if the initially chosen point cannot accept the parcel.

  • Delivery hours: Deliveries are made from Monday to Friday from 8 am to 6 pm, and in some territories also on Saturday between 8 am and 3 pm.

  • Verification upon receipt: At the time of collection, it is crucial to check the condition of the parcel. In case of damage, it is necessary to place a reservation on the delivery note to guarantee the possibility of a refund by DPD.

  • Non-collection of the parcel: If the parcel is not collected at the relay within 9 calendar days following the deposit, it will be returned to the sender. In this case, a new shipment will be at your expense.

  • Delivery notification: Recipients are informed by SMS and email of the scheduled delivery day and the precise time slot, accompanied by a personal code to secure the transaction.

Transport refund in case of delay: Some carriers guarantee their transport times and provide a refund under certain conditions if the deadline is exceeded.

  • GLS: no refund in case of extended delays

  • Mondial Relay: No refund in case of extended delays

  • Colissimo: full or partial refund depending on the delay. The refund amounts are those in force according to Colissimo’s scales. In this case, Rabbits World will take the necessary steps and refund you. IMPORTANT: in the event of special events, the conditions for refund or delay may be suspended: climatic accidents, strikes… In all cases, refunds related to transport are made in accordance with the carrier’s conditions.

Non-collection of parcel by the customer:

If the customer fails to collect their parcel from the collection point within the time limit set by the carrier, the parcel will be returned to RABBITS WORLD. Such non-collection is treated as the exercise of the right of withdrawal. In accordance with Article L. 221-23 of the French Consumer Code, the direct costs of returning the parcel are borne by the customer.

The customer may choose between two options:

  • A refund of the order (including the original shipping costs), less the actual return costs charged by the carrier;

  • Re-shipment of the parcel, subject to prior payment by the customer of the applicable shipping costs at the time of the request.

The customer has 14 days from the date on which the returned parcel is received by RABBITS WORLD to communicate their choice by contacting customer service at vivienne@rabbits.world. In the absence of a response within this period, RABBITS WORLD will proceed with a refund as described above.

9. Force Majeure

Expressly considered as cases of force majeure, in addition to those usually retained by the jurisprudence of French Courts and tribunals: total or partial strikes, internal or external to the company, governmental or legal restrictions, computer breakdowns, telecommunications blockages including networks and in particular the Internet. The seller cannot be held responsible in the event of force majeure (strike, natural disaster, pandemic, etc.). The occurrence of a case of force majeure will initially suspend, by right, the execution of the order.

10. Claim for Non-Conformity

In the event of an error on the product, the customer undertakes to return said product or the products concerned within a reasonable time after noticing the defect to RABBITS WORLD according to the same terms as those of the right of withdrawal. Upon receipt of the product in due form, RABBITS WORLD will resend, at its expense, the initially ordered product.

11. Right of Withdrawal

In accordance with the provisions in force (Article L221-18 of the Consumer Code), the buyer has a period of 14 days to exercise their right of withdrawal from a contract concluded at a distance (telephone canvassing or off-premises).

The period runs from the day:

  • of the conclusion of the contract, for service provision contracts;

  • of the receipt of the goods by the consumer or a designated third party, other than the carrier, for contracts for the sale of goods.

In the case of an order for several goods delivered separately or in the case of an order for a good composed of multiple lots or pieces whose delivery is staggered over a defined period, the period runs from the receipt of the last good or lot or the last piece.

The right of withdrawal can be exercised online, using a form available here or any other unambiguous durable medium:

  • email address: vivienne@rabbits.world

  • postal address: RABBITS WORLD, 125 rue de l’artisanat, 42110 CIVENS;

  • phone: +33 (0)7 83 41 94 18;

In the event of a dispute concerning the exercise of the right of withdrawal, the burden of proof lies with the consumer in accordance with Article L221-22 of the Consumer Code.

Exclusions from the right of withdrawal: Under Article L221-28 of the Consumer Code, the right of withdrawal is excluded for:

  • services fully executed before the end of the withdrawal period and whose execution began after the consumer’s prior express agreement and express waiver of their right of withdrawal;

  • goods made to the consumer’s specifications or clearly personalized;

  • goods liable to deteriorate or expire rapidly;

  • goods unsealed by the consumer after delivery and which cannot be returned for hygiene or health protection reasons;

  • audio or video recordings or computer software when they have been unsealed by the consumer after delivery;

  • sales of newspapers, periodicals, or magazines, except for subscription contracts.

  • The non-collection of a parcel from a collection point is treated as the exercise of the right of withdrawal. The applicable refund or re-shipment terms are set out in Article 8 of these Terms and Conditions.

In accordance with regulations, the right of withdrawal does not apply to products liable to deteriorate rapidly or for hygiene reasons, when they have been opened after delivery.

When the buyer exercises their right of withdrawal, the products must be returned in their original packaging and in perfect condition to RABBITS WORLD 125 rue de l’artisanat, 42110 CIVENS within 14 days following the notification to the seller of the decision to withdraw.

The seller refunds the consumer all sums paid, including delivery costs, without undue delay and at the latest within 14 days from the date on which they are informed of the consumer’s decision to withdraw. For sales of goods, the seller may defer the refund until the goods are recovered or proof of shipment of the goods by the consumer is provided. The refund is made using the same payment method as the one used during the order, unless otherwise agreed.

Return costs are the responsibility of the buyer. According to Article L221-17 of the Consumer Code, the exercise of the right of withdrawal terminates the obligations of the parties. The withdrawal from a main distance contract automatically terminates any ancillary contract, at no cost to the consumer other than those provided for in Articles L221-23 to L221-25 of the Consumer Code.

12. Guarantee

Legal guarantee of conformity and legal guarantee against hidden defects

The seller RABBITS WORLD is liable for conformity defects of the goods to the contract under the conditions of Articles L. 217-3 and following of the Consumer Code and for hidden defects of the item sold under the conditions provided for in Articles 1641 and following of the Civil Code.

In accordance with Article D. 211-2 of the French Consumer Code, the applicable legal guarantees are summarised in the box below:

The consumer has a period of two years from the delivery of the goods to obtain the implementation of the legal guarantee of conformity in the event of a conformity defect appearing. During this period, the consumer is only required to establish the existence of the conformity defect and not the date on which it appeared.

Where the contract of sale of the goods provides for the supply of digital content or a digital service on a continuous basis for a period of more than two years, the legal guarantee applies to that digital content or digital service throughout the planned supply period. During this period, the consumer is only required to establish the existence of the conformity defect affecting the digital content or digital service and not the date on which it appeared.

The legal guarantee of conformity entails an obligation on the trader, where applicable, to provide all updates necessary to maintain the conformity of the goods.

The legal guarantee of conformity gives the consumer the right to repair or replacement of the goods within thirty days of their request, free of charge and without major inconvenience to them.

If the goods are repaired under the legal guarantee of conformity, the consumer benefits from a six-month extension of the original guarantee.

If the consumer requests repair of the goods but the seller imposes replacement, the legal guarantee of conformity is renewed for a period of two years from the date of replacement of the goods.

The consumer may obtain a reduction in the purchase price while keeping the goods, or terminate the contract and receive a full refund upon return of the goods, if:

  • 1° The trader refuses to repair or replace the goods;

  • 2° The repair or replacement of the goods takes place after a period of thirty days;

  • 3° The repair or replacement of the goods causes a major inconvenience to the consumer, in particular where the consumer permanently bears the costs of collection or removal of the non-conforming goods, or bears the installation costs of the repaired or replacement goods;

  • 4° The non-conformity of the goods persists despite the seller’s unsuccessful attempt to bring them into conformity.

The consumer is also entitled to a reduction in the price of the goods or to termination of the contract where the conformity defect is so serious that it justifies an immediate price reduction or termination. The consumer is then not required to first request repair or replacement of the goods.

The consumer is not entitled to rescind the sale if the conformity defect is minor.

Any period during which the goods are immobilised for the purpose of repair or replacement suspends the remaining guarantee until the restored goods are delivered.

The rights mentioned above result from the application of Articles L. 217-1 to L. 217-32 of the French Consumer Code.

A seller who acts in bad faith to obstruct the implementation of the legal guarantee of conformity is liable to a civil fine of up to 300,000 euros, which may be increased to 10% of average annual turnover (Article L. 241-5 of the French Consumer Code).

The consumer also benefits from the legal guarantee against hidden defects under Articles 1641 to 1649 of the French Civil Code, for a period of two years from the discovery of the defect. This guarantee entitles the consumer to a price reduction if the goods are retained, or to a full refund upon return of the goods.

17. Entire Agreement and Nullity

A change in legislation, regulation, or a court decision rendering one or more clauses of these General Terms and Conditions of Sale null and void shall not affect the validity of these General Terms and Conditions of Sale. Such a change or finding could in no case allow the Customer not to comply with these General Terms and Conditions of Sale. If a condition was not explicitly mentioned, it would be considered as governed by the practices in force in the distance selling sector whose companies are headquartered in France.

18. Non-Waiver

The fact that RABBITS WORLD does not avail itself of a breach by the customer of any of its obligations cannot be interpreted as a waiver of the obligation concerned and to avail itself of this breach subsequently.

19. Consumer Mediator

20. Dispute

This contract is subject to French law, both for substantive rules and for formal rules. In the event of a dispute and failing an amicable agreement between the parties, the consumer may seize either one of the territorially competent jurisdictions under the Code of Civil Procedure, or the jurisdiction of the place where they lived at the time of the conclusion of the contract or the occurrence of the harmful event.

21. Duration and Application

These Conditions apply to any purchase made on the www.rabbits.world website. These Conditions can be modified at any time by RABBITS WORLD. The applicable Conditions are those in force on the date of registration of the order.
